CHAPTER 67 – MILITARY AND NAVY

Sec. 1385. Use of Army and Air Force as posse comitatus

Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.

Explanatory Note:

This law was created to assure that the political leaders of the USA cannot utilize the US Military to enforce laws or make acts of aggression upon American Citizens on the soil of the USA.

Many people have the misconception that the posse comitatus is an absolute ban of the use of US military on home soil against American Citizens. In fact it is not.
